Welcome to FishPass. Please read these Terms of Service ("Terms") carefully before using the FishPass mobile application ("the App") operated by FishPass ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.
FishPass is an educational application designed to help users prepare for fishing license tests in various German states. The App provides practice questions, learning materials, and test simulations related to fishing regulations, fish species identification, and proper fishing techniques.
While we strive to provide accurate and up-to-date information, FishPass is intended as a study aid only. The App is not a substitute for official fishing license test materials issued by German authorities. We recommend that users consult official sources for the most current fishing regulations and test requirements in their specific region.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes. You may not:
The App, including its content, features, and functionality, is owned by FishPass and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
The quiz questions, explanations, fish descriptions, and other educational content within the App are either owned by us or we have permission to use them. You may not copy, modify, distribute, or create derivative works based on this content without express permission.
FishPass primarily functions as an offline application. Your progress, quiz results, and settings are stored locally on your device. You are responsible for maintaining the confidentiality of your device and any account information.
If future versions of the App include online features requiring account creation, you will be responsible for maintaining the confidentiality of your account and password and for restricting access to your account.
We may update the App from time to time to improve performance, enhance functionality, reflect changes to the operating system, address security issues, or update content. These updates may occur automatically depending on your device settings.
We reserve the right to modify or discontinue, temporarily or permanently, the App or any features or portions thereof without prior notice. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuance of the App or any part thereof.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will function without error or interruption, that defects will be corrected, or that the App or the server that makes it available are free of viruses or other harmful components.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Germany.
We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or by posting a notice in the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
